Agreement to Terms

These Terms and Conditions (“Terms”) apply to your use of the Barnum Lawn & Landscape website and to all landscaping, property maintenance, snow management, and related services provided by Barnum Lawn & Landscape (“we,” “us,” “our”) to clients (“you,” “your”) in West Hartford, CT and surrounding areas.

By visiting our website, contacting us, requesting a quote, or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

Services

We provide lawn care, landscaping, property maintenance, snow management, and related outdoor services. The specific work, materials, and price for each job will be described in a written or emailed estimate, proposal, or invoice (“Estimate”). If these Terms conflict with a signed Estimate, the Estimate controls.

Estimates and Pricing

  • Estimates are based on the information you provide and our assessment of your property.

  • If we find conditions we could not reasonably have known about, such as buried debris, poor soil, irrigation problems, or underground obstacles, we will tell you before doing additional work. Additional work requires your approval and may change the price.

  • Prices do not include permits, disposal fees, or special equipment rentals unless the Estimate says so.

Scheduling and Weather

  • Dates and times are estimates, not guarantees.

  • Weather, ground conditions, equipment issues, and other circumstances outside our control may delay or reschedule work. We will notify you as soon as reasonably possible.

Property Access and Your Responsibilities

You agree to:

  • Give us safe and reasonable access to the work area on the scheduled day.

  • Move vehicles, furniture, toys, and other items out of the work area.

  • Secure pets.

  • Tell us about anything in the work area that could be damaged or that we need to avoid, including irrigation lines, invisible pet fences, septic systems, and buried lines or cables that are not marked.

  • Confirm that you own the property or have permission from the owner to authorize the work.

We will contact the required utility-marking service before any digging. We are not responsible for damage to unmarked or inaccurately marked underground lines, systems, or objects.

Payment

Payment terms, including any deposit, due dates, and late fees, will be stated in your Estimate or invoice. We may pause work if payments are overdue.

Cancellations and Rescheduling

Please give us as much notice as possible if you need to cancel or reschedule. Any deposit, cancellation, or refund terms will be stated in your Estimate. If we need to cancel or reschedule, we will notify you promptly.

Our Work

We perform our work in a professional and workmanlike manner. If you are not satisfied with any part of our work, please contact us promptly after completion and give us a reasonable opportunity to review and correct it.

Limitation of Liability

To the fullest extent allowed by law, Barnum Lawn & Landscape is not liable for indirect, incidental, or consequential damages, including lost use of property or loss of income. Our total liability for any claim related to our services will not exceed the amount you paid us for the specific service that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

Website Use

Our website is provided “as is” for general information. You agree not to misuse it, attempt to interfere with its operation, or submit false or harmful information. The content on our website, including text, photos, and logos, belongs to Barnum Lawn & Landscape or its licensors and may not be copied or reused without our permission.

Photos of Our Work

We may photograph completed work for our portfolio, website, and marketing. We will not show your name or exact address without your permission. Tell us if you would like us not to use photos of your property.

Privacy

Our Privacy Policy explains how we handle your personal information. By using our website or services, you agree to its terms.

Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Any dispute will be handled in the state or local courts located in Hartford County, Connecticut.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above shows when changes were last made. Changes do not affect work already agreed to in an Estimate.
